City of Plainview Reminds Citizens Pools Must be in Rear or Side Yards with Fencing

Swimming pools in general are permitted in the rear and side yards provided that they meet the following conditions:

Every outdoor swimming pool shall be completely surrounded by a barrier or enclosure: 

  • The barrier shall be not less than four feet (4') in height, which shall be so constructed as not to have any openings, holes, or gaps larger than four inches (4") in any dimension except for doors and gates; and if a picket fence is erected or maintained the horizontal dimension shall not exceed four inches (4”).
  • Chain link dimensions: the maximum opening formed by a chain link fence shall be not more than 1.75 inches (44mm). 
  • Where the fence is provided with slats fastened at the top and bottom which reduces the opening, such openings shall be not more than 1.75 inches (44mm). 
  • All gates or doors opening through such enclosure shall be equipped with a self-closing and self-latching device for keeping the gate or door securely closed at all times when not in actual use.

If the pool is a minimum of 24 inches depth, any person in possession of land within the City limits, either as owner, purchaser, lessee, tenant or licensee, is required to provide and maintain a fence or wall for provided swimming pool.
